1. Description of Services

Magik★Cirql provides a platform for generating, customising, managing, and analysing static and dynamic QR codes. We reserve the right to: - Add, suspend, or remove features at any time; - Perform maintenance or upgrades that may interrupt service; - Offer both free and paid tiers of functionality.

2. User Accounts

Some features require a user account. When registering: - You must provide accurate and up-to-date information; - You are responsible for maintaining the confidentiality of your credentials; - You are responsible for all activity under your account; - If you suspect unauthorised access, contact us immediately. We reserve the right to suspend or close your account if we believe your activity is harmful, illegal, or in breach of these Terms.

3. Acceptable Use Policy

You agree to use Magik★Cirql only for lawful and respectful purposes. You must not use our services to: - Link to harmful, illegal, offensive, misleading, or obscene content. This includes linking to any pornography or adult content. - Promote or incite hatred, violence, discrimination, or harassment; - Infringe upon any intellectual property, privacy, or publicity rights; - Distribute spam, viruses, or unauthorised advertising; - Interfere with the performance, integrity, or security of our systems or others' use; - Impersonate others or misrepresent your identity or affiliation. Violation may lead to account suspension or permanent termination.

4. Intellectual Property

The Magik★Cirql platform, design, logos, software, and content are the exclusive property of Crowers Limited and are protected by international copyright, trademark, patent, and trade secret laws. You may not copy, reverse-engineer, sell, or distribute any part of our service without written consent.

5. User Content

You retain full rights to any content you upload, post, or link to using our service. By using Magik★Cirql, you grant us a worldwide, non-exclusive, royalty-free licence to host, reproduce, adapt, and display your content as necessary to deliver the service. You must ensure that any content linked via QR codes is lawful and does not infringe third-party rights.

6. Dynamic QR Codes & Redirects

Dynamic QR codes allow you to update the linked destination after the code has been generated. You must not redirect a dynamic QR code to content that is deceptive, illegal, offensive, or significantly different from its original purpose. We reserve the right to disable redirects or suspend accounts misusing dynamic QR codes.

7. Analytics & Tracking

When a dynamic QR code is scanned, we may collect the following: - IP address and location (if available); - Device and browser details; - Date and time of scan. This data is shown to you as part of our analytics service. If you use this data for marketing or profiling, you must comply with the UK GDPR, including informing end users and obtaining necessary consent.

8. Data Privacy & Security

We take data protection seriously. See our full Privacy Policy for details. - We do not sell your personal data; - Data is stored securely in UK/EU or other GDPR-compliant locations; - You may request access, correction, or deletion of your data at any time; - We implement security measures appropriate to the nature of the data.

9. Third-Party Services

Magik★Cirql may offer integrations with tools like Canva and others. - These services are provided by third parties with their own terms and privacy policies; - We are not responsible for the availability, content, or behaviour of third-party services.

10. Termination

You may cancel your account at any time. We may suspend or terminate your access if: - You breach these Terms; - Your conduct is harmful to other users or our platform; - We are legally required to do so. If your account is terminated: - Static QR codes will remain functional unless we are legally compelled to disable them; - Dynamic QR codes may stop redirecting, and analytics will no longer be accessible; - Your data may be deleted in accordance with our retention policies.

11. Limitation of Liability

To the fullest extent permitted by law: - Magik★Cirql is provided "as-is" and "as-available"; - We do not guarantee uninterrupted, error-free, or secure access; - We are not liable for: - Indirect or consequential losses; - Data loss; - Profit loss; - Losses from unauthorised access, account misuse, or third-party services. Our total liability is capped at the amount you've paid us in the last 12 months.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved exclusively in the courts of England.

13. Changes to These Terms

We may update these Terms from time to time. - If the changes are material, we will notify you by email or via the website; - Continued use of the service after changes indicates your acceptance; - You are responsible for checking this page regularly.
